3. Agreement and Acceptance

By accessing our Website, creating an account, or placing an Order, you agree to be bound by these Terms and Conditions in their entirety. If you do not agree, you may not use our Website or Services.

These Terms are concluded electronically in terms of ECTA and constitute a binding agreement between you and Juel Haus (Pty) Ltd.

You confirm that you are at least 18 years of age and legally capable of entering into binding contracts under South African law.

4. Our Services

Juel Haus provides curated, personalised welcome gift baskets for accommodation hosts — including Airbnb and Booking.com hosts, boutique hotels, and guesthouses operating in South Africa.

Each Order includes:

Important: Each gift basket is individually assembled and personalised for a named guest at a specific property. Once assembly has commenced, the basket cannot be repurposed, resold, or returned.

5. Ordering Process

5.1 Placing an Order

Orders are placed through our secure online checkout. You must be registered and logged in to place an Order. By submitting an Order, you make an offer to purchase subject to these Terms.

5.2 Order Confirmation

An Order is accepted and a binding contract formed only upon our written confirmation via email to the address registered on your account. We reserve the right to decline any Order, including where stock is unavailable or where we suspect fraudulent activity.

5.3 Accuracy of Information

You are solely responsible for the accuracy of all information provided at checkout, including property address, guest name, check-in and check-out dates, Wi-Fi credentials, and branding preferences. Juel Haus accepts no liability for errors arising from incorrect Customer-supplied information.

5.4 Lead Time

Orders must be placed with sufficient lead time to allow assembly and delivery before the guest's check-in date. We recommend placing Orders at least 3 Business Days before the required delivery date. We cannot guarantee delivery for Orders placed with insufficient lead time.

6. Pricing, VAT & Payment

6.1 Pricing

All prices displayed on our Website are in South African Rand (ZAR). As Juel Haus is not currently VAT registered, prices are VAT-exclusive and no VAT is charged. Prices are subject to change without notice; however, the price applicable to your Order is the price confirmed at the time of Order confirmation.

6.2 Payment

Full payment is required before assembly of your Order commences. Payment is processed securely through PayFast, a PCI-DSS-compliant South African payment gateway. We accept major South African bank cards, instant EFT, and other payment methods displayed at checkout.

6.3 Failed Payments

If payment is not received within 24 hours of Order submission, the Order will be cancelled automatically. We are not liable for any loss suffered as a result of a failed or declined payment.

6.4 Invoicing

A transaction record will be emailed to you on successful payment in terms of ECTA Section 43(5).

7. Delivery

7.1 Delivery Area

We currently deliver within South Africa. Delivery is handled by our logistics partner, The Courier Guy. Delivery to your specified property address is included in the product price unless otherwise stated.

7.2 Delivery Timing

We will make every reasonable effort to deliver your Order before the specified check-in date. However, we cannot guarantee delivery dates where circumstances outside our reasonable control cause delays, including courier failures, adverse weather, or national public holidays.

7.3 Risk and Ownership

Risk of loss or damage to Products passes to you upon delivery to the property address. Ownership of the Products passes to you upon receipt of full payment.

7.4 Failed Deliveries

If delivery is unsuccessful due to an incorrect address provided by you, or if no one is available to receive the delivery and the courier cannot leave the parcel securely, a redelivery fee may apply. You will be notified via email.

7.5 Waybill Tracking

A waybill number will be provided via your account dashboard once your Order is dispatched, allowing you to track delivery via The Courier Guy's tracking portal.

8. Cancellation & Refunds

8.1 Cancellation Before Assembly

You may cancel an Order without penalty at any time before assembly of your gift basket has commenced. To cancel, contact us via our website with your order reference. A full refund will be processed within 7 Business Days to your original payment method.

8.2 Cancellation After Assembly Has Commenced

Important — Custom Goods Exception (CPA Section 17(2)(d)): Once assembly of your personalised gift basket has begun, the Order cannot be cancelled and no refund will be issued. Each basket is manufactured to your specific requirements — personalised with guest names, custom QR codes, branded packaging, and curated contents — and cannot be resold or reused for another guest.

Assembly typically commences within 24 hours of payment confirmation. If you need to cancel, you must contact us immediately after placing your Order.

8.3 Cooling-Off Period for Direct Marketing

If you were approached directly by Juel Haus and purchased as a result of that direct marketing approach, you have the right to cancel within 5 Business Days of entering into the agreement, even after assembly has commenced, in terms of CPA Section 16. Cancellation instructions will be provided in any marketing communication.

8.4 Damaged or Incorrect Orders

If your Order arrives damaged or materially incorrect, you must notify us within 48 hours of delivery via our website, with photographs of the damage. We will, at our election, either replace the affected items or issue a partial refund, in compliance with our obligations under CPA Section 56.

8.5 Refund Processing

Approved refunds are processed within 7 Business Days. Refunds are made to the original payment method. We do not process cash refunds.

9. Quality Guarantee & Remedies

All Products are sourced from reputable South African artisans and suppliers. We guarantee that Products will be:

Perishable items (such as food products) are subject to the expiry dates of the individual items. Juel Haus accepts no liability for perishables that expire after delivery where the delivery occurred within the specified timeframe.

These guarantees are in addition to your statutory rights under the CPA Section 56 implied warranty, which cannot be excluded or limited.

10. Personal Information & POPIA

Juel Haus processes personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).

You, as the host, are responsible for ensuring you have the necessary authority to share your guests' personal information with us for the purposes of generating personalised welcome gifts. By submitting guest details at checkout, you confirm that you have obtained any required consent or have a lawful basis under POPIA to share that information.

10.5 Retention

We retain Order and customer records for a minimum of 5 years to satisfy SARS tax record-keeping requirements, after which data is securely deleted. Welcome Page data (guest details, QR codes) is retained for the duration of your account and may be deleted on request after your guest's departure.

11. Intellectual Property

All content on this Website — including text, images, logos, product photographs, QR code designs, and software — is the property of Juel Haus (Pty) Ltd or is used under licence, and is protected by South African and international copyright law.

You may not reproduce, distribute, or create derivative works from any content on this Website without our prior written consent.

By uploading or submitting any content to us (such as your brand logo or property photographs), you grant Juel Haus a non-exclusive, royalty-free licence to use that content solely for the purpose of fulfilling your Order.

12. Limitation of Liability

To the maximum extent permitted by applicable South African law:

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded under the CPA or any other applicable law.

13. Dispute Resolution

We are committed to resolving disputes quickly and fairly. If you have a complaint:

  1. Contact us first — submit your complaint via our website at www.juelhaus.co.za. We will acknowledge within 2 Business Days and aim to resolve within 10 Business Days.
  2. National Consumer Commission (NCC) — if we cannot resolve your complaint, you may refer it to the NCC at thencc.org.za or 012 428 7000, in terms of CPA Section 69.
  3. Consumer Goods and Services Ombud (CGSO) — alternatively, disputes may be referred to the CGSO at cgso.org.za.
  4. Court proceedings — as a last resort, disputes shall be subject to the jurisdiction of the courts of the Western Cape in terms of Clause 14 below.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. You consent to the jurisdiction of the Western Cape Division of the High Court of South Africa (or a Magistrate's Court of competent jurisdiction) for resolution of any dispute arising from these Terms.

15. Amendments

We may update these Terms and Conditions from time to time. The version published on our Website at the date of your Order is the version that applies to that Order. We will notify registered customers of material changes via email. Continued use of the Website after such notification constitutes acceptance of the revised Terms.
